User Question: I applied for asylum five months ago but haven’t received my EAD yet. However, I have my asylum interview scheduled for next month. This is an affirmative asylum case, and I am currently in Florida. I am worried because they called me early, and I fear being rejected. If I lose, can I apply in court?

Expert Answer: Being scheduled for an asylum interview early does not necessarily mean a denial. Interview timing varies based on asylum office workload. Prepare thoroughly by gathering strong evidence, including country conditions, personal statements, and legal support. If your affirmative asylum case is denied, it will be referred to Immigration Court if you do not have valid status. In court, you can reapply defensively before an immigration judge. Consider consulting an immigration attorney for guidance on preparing for both the interview and possible court proceedings.
