User Question: I currently have a pending asylum application and have received my (EAD) + (SSN). I'm considering returning to my home country, despite safety concerns. What steps do I need to take before departing the US? Do I simply need to purchase a flight ticket, or must I first withdraw or cancel my asylum application? Please provide guidance on the necessary procedures.

Expert Answer: If you choose to return to your home country while your asylum application is still pending, you should be aware of serious legal consequences. Departing the U.S. may be interpreted as abandoning your asylum claim, and re-entering could be extremely difficult. Before leaving, you may formally withdraw your application by notifying USCIS or the immigration court (if your case is with the EOIR). However, withdrawing does not guarantee you will be able to return to the U.S. easily in the future. If you are concerned about safety but still wish to travel, consider applying for a Refugee Travel Document (RTD) instead. Consult an immigration attorney before making any final decisions to fully understand the risks involved.
